4. Registration and Account

4.1. Using most of the Service’s features requires creating an Account. Registration is free of charge.

4.2. To create an Account, the User provides an e-mail address and sets a password. After confirming the e-mail address, the Account becomes active.

4.3. An Account may be created by:

  • adults with full legal capacity,
  • minors aged 16 or over with the consent of their legal representative (consent submitted by e-mail to kontakt@lern.one); persons under 16 do not create an Account on their own, and a Student Account for them can only be created at the invitation of a Tutor, who is responsible for obtaining the consent of a parent or legal guardian (§13.3),
  • legal persons and organisational units without legal personality, represented by a person authorised to act on their behalf.

4.4. The User undertakes to provide true and up-to-date data. In the event of any change, the User will update it in the Account settings.

4.5. The User undertakes to keep login credentials confidential and not to share the Account with third parties. Actions taken from the Account are deemed to be taken by the User, unless the User proves that the Account was used without their knowledge and consent.

4.6. The User may at any time request deletion of their Account via the function available in Account settings or by sending a request to kontakt@lern.one. The request is equivalent to termination of the agreement for the provision of Services with immediate effect - the Account loses access to the Service's functions. Permanent deletion of the User's data takes place after verification of the request by the Service Provider, no later than within 30 days, subject to the Service Provider's legal obligations (accounting, invoice archiving) and the time necessary to protect the procedure against abuse (e.g. an attempt to delete an Account by an unauthorized person). Deleting the Account does not entitle the User to a refund of the fee for the current Billing Period, without prejudice to the Consumer's rights under §7 and §18.3.

4.7. Commercial information. Sending commercial information by electronic means requires a separate, voluntary consent, which is not a condition for creating an Account or using the Service; the rules are described in the Privacy Policy (§22). Service messages related to the Account (e.g. a reminder about unfinished setup, confirmations, invoices) are sent regardless of this consent.

5. Scope of Services provided

Within the Service, the Service Provider provides the following services:

  • Interactive Whiteboard - a shared space for drawing, writing and solving tasks in real time between the Tutor and the Student.
  • Chats and audio/video calls - communication between the Tutor and the Student via text messages and voice and video calls.
  • Invoices and billing - tools for issuing invoices (with VAT or under the exemption of Art. 113 of the Polish VAT Act) and for collecting payments from Students.
  • Educational task database - access to a collection of tasks from the matura exam, the eighth-grader exam and tests, together with an answer key.
  • Homework - a tool for creating and assigning homework to Students and grading answers.
  • AI Assistant - help in preparing lesson plans, generating quizzes and flashcards, searching for tasks.
  • Files and materials - storage space for keeping educational materials (Materials) and private documents (Documents).
  • Student progress - tracking topic mastery, generating reports for parents.

The detailed scope of functionality in individual Tariff plans is specified on the Pricing page.

Technical requirements. To use the Service you need: a device with internet access, a current browser (Chrome, Edge, Firefox or Safari in one of the two latest major versions) with JavaScript enabled and with the cookies and local storage necessary for the Service to work, and, for audio and video calls, a microphone, a camera and the browser's permission to use them. An accessible e-mail address is required to activate the Account.

6. Subscription and payments

6.1. Using the Service after the trial period requires a paid Subscription. Without a Subscription the Account is paused: the User can download their data (students, billing and boards) or delete the Account together with its data, but cannot create or change content until they choose a Tariff plan. Pausing the Account does not delete any data.

6.2. Current prices and the scope of plans are available on the Pricing page. Prices are given in Polish zloty (PLN) and are gross prices.

6.3. Trial period. Each Tutor may use a 14-day free period of full access to the Service once. The trial does not require a payment card and does not turn into a paid Subscription automatically. Accepting payments from students is not available during the trial, and the Service Provider may apply limits that protect the Service against abuse. The User may extend the trial once by 7 days by filling in a feedback form and consenting to receive marketing information; the consent can be withdrawn at any time without losing the extension. Creating further Accounts in order to use the trial again is prohibited. If a violation is found, the Service Provider may end the trial or block the Accounts that break this rule. After an Account is deleted, the Service Provider keeps an encrypted hash of the email address and hashed device identifiers for 24 months solely so the trial is not granted again; an Account created again with the same address does not receive a trial.

6.4. Payments. Payments are handled by Stripe Payments Europe Ltd. - the Service Provider does not store payment card numbers or other sensitive payment data.

6.5. Billing period. The Subscription renews automatically at the end of each Billing period (monthly or annual), unless the User cancels it earlier.

6.6. Plan change. The User may change the Tariff plan at any time. On upgrade, the amount proportional to the remaining period is added to the next invoice (proration). On downgrade, the change takes effect at the end of the current Billing period (the User does not lose the value of the paid period).

6.7. Invoices. After each paid Subscription, the User receives an invoice (with or without VAT) (in accordance with the Service Provider’s tax status). Invoices are also available in the User panel.

6.8. Referral programme. A User may recommend the Service to other Tutors using a unique referral link available in Account settings. The referred person receives a discount on the first paid Subscription billing period. The referring User receives a reward (a discount or a credit on their billing account) once the referred person pays for the Subscription and a 14-day grace period protecting against abuse has elapsed. Detailed rules of the programme, including the annual limit on the number of rewards and anti-abuse mechanisms (e.g. detection of registrations from the same device or IP address - details in the Privacy Policy), are available in Account settings under the "Refer friends" tab.

6.9. Time-limited promotions. The Service Provider may periodically run time-limited promotions (e.g. a "Summer Promotion"), announced on the Service's website, granting selected Users free or discounted access to a higher Subscription plan until a specified date. Participation in a promotion may require providing payment card details - the absence of a registered payment method may result in automatic termination of promotional access. After the promotional period ends, the Subscription automatically converts to a paid plan at the prices listed in the Pricing, and renews on a recurring basis in accordance with §6.5, unless the User cancels it beforehand in accordance with §7.1. Time-limited promotions cannot be combined with the trial period referred to in §6.3 and are available only to Accounts meeting the conditions specified in the announcement of the given promotion (e.g. only new Accounts, until a specified sign-up deadline).

7. Cancellation, termination, withdrawal from the agreement

7.1. Cancellation of the Subscription. The User may cancel the Subscription at any time in the User panel or via the Stripe Customer Portal. Cancellation takes effect at the end of the current Billing period - until then the Subscription works normally.

7.2. Right of withdrawal (Consumer). The Consumer has the right to withdraw from a distance contract within 14 days of its conclusion (Art. 27 of the Polish Consumer Rights Act of 30 May 2014).

7.3. Starting the service before the withdrawal period expires. A Consumer who wants to use the paid features of the Subscription before the withdrawal period expires should expressly request this during the order. If the Consumer withdraws after making such a request, they will pay for the service provided up to the moment of withdrawal, in an amount proportionate to the used part of the Billing Period (Art. 35 of the Consumer Rights Act), and the remainder of the fee will be refunded. If the Consumer did not make such a request, they receive a refund of the entire fee paid upon withdrawal.

7.4. Form of withdrawal. Withdrawal must be reported by e-mail to kontakt@lern.one within 14 days, from the e-mail address assigned to the Account. The Consumer may, but does not have to, use the template in point 7.5. The refund is made within 14 days of receipt of the statement, using the same payment method the Consumer used, unless the Consumer expressly agrees to another method.

7.5. Withdrawal form template. (Complete and return this form only if you wish to withdraw from the contract.) To: Lern Solutions sp. z o.o., ul. Warszawska 2, 05-252 Małopole, kontakt@lern.one. I/We(*) hereby give notice that I/We(*) withdraw from my/our(*) contract for the provision of the following service: Subscription to the lern.one service. Date of conclusion of the contract: ........ Name of the consumer(s): ........ Address of the consumer(s): ........ Date: ........ (*) Delete as appropriate.

8. User obligations

The User undertakes to:

  • use the Service in accordance with the Terms, the law and good practice,
  • not enter into the Service any unlawful, offensive content infringing the rights of third parties, in particular copyright and personal rights,
  • not send spam, unwanted commercial communication or malicious software,
  • not attempt to gain unauthorised access to the Service, other Users’ data or the Service Provider’s infrastructure,
  • not use the Service for activities infringing copyright (e.g. mass downloading of exam tasks for redistribution),
  • not overload the Service excessively and without justification (e.g. automated queries, scraping, DDoS attempts),
  • respect the rights of other Users, in particular the right to privacy, dignity and freedom of expression,
  • follow the Account security rules (strong password, logging out from public devices).

In the event of a breach of the above obligations, the Service Provider may suspend or delete the User’s Account, and in particularly serious cases pursue claims for damages.

9. Moderation and Account Security

9.1. Verification and contact. The Service Provider may contact the User to clarify circumstances raising doubts - in particular reports from other Users, unusual Account activity, or suspected violation of these Terms - before taking further action.

9.2. Suspending and deleting Accounts in case of abuse. Regardless of the provisions of §8 above, the Service Provider has the right to suspend access to an Account, limit its functionality, or permanently delete it, in particular in the event of:

  • sending spam or unsolicited communications through the Service,
  • creating multiple Accounts to circumvent a block, Subscription plan limits, or a trial period,
  • registering using fictitious data, temporary/disposable e-mail addresses, or domains created solely to bypass the Service's security measures,
  • other conduct constituting abuse, fraud, or an attempt to destabilize the Service.

9.3. Automated anti-abuse measures. To detect attempts to circumvent a block or mass-create fake Accounts, the Service Provider may use automated technical measures (e.g. a hashed device/browser signature) - details in the Privacy Policy. These measures serve solely to protect the Service against abuse and are not used to profile Users for any other purpose.

9.4. Access to User content for diagnostic purposes. Authorized personnel of the Service Provider may access content created by the User in the Service (including Board content, files, messages) solely: (a) in response to a bug report, a request for technical support, or a complaint submitted by the User, (b) to detect and clarify a suspected violation of these Terms or a threat to the Service's security, (c) at the request of authorized state authorities. Such access is limited to the scope necessary for the given purpose, is logged on each occasion, and personnel of the Service Provider are obliged to keep confidential any content they access.

9.5. Proportionality and appeal. Before applying the measures referred to in point 9.2, the Service Provider - where the nature of the situation allows - attempts to contact the User or issues a warning. Immediate suspension or deletion of an Account without prior warning may occur in the case of unlawful content, a threat to the safety of other Users or the Service, or a flagrant violation of these Terms. The User has the right to object to a decision taken by sending a message to kontakt@lern.one - the Service Provider will review the objection without undue delay.

9.6. Reporting unlawful content. Anyone may report to kontakt@lern.one content in the Service that they consider unlawful (e.g. in a public profile, a review or materials). The report should state the URL or location of the content, the reasons why it is unlawful, and the reporter's contact details. We confirm receipt of the report and inform the reporter of the decision. If we remove content or restrict access to an Account, we will give the User a statement of reasons (the circumstances, the basis, and the option to object under point 9.5). The same address serves as the point of contact for public authorities and Users within the meaning of Regulation (EU) 2022/2065 (DSA).

10. User Content

10.1. By entering User Content into the Service, the User declares that they hold all rights to it or have the consents of the entitled persons allowing its processing by the Service Provider.

10.2. The User grants the Service Provider a non-exclusive, royalty-free licence to store, copy, transmit and display User Content to the extent necessary to provide the Services. The licence expires upon deletion of the Content or the Account by the User.

10.3. The Service Provider does not use User Content for purposes other than providing the Services. In particular, we do not use it to train artificial intelligence models or share it with third parties for commercial purposes.

10.4. Export and deletion. The User may at any time download a copy of their Content (JSON export) or delete it. Deletion of Content is permanent - its later restoration is not possible. Backups are deleted on a 30-day retention cycle.

10.5. Automatic cleanup of inactive Boards. The graphical content of a Board (drawings, elements, attached files) is automatically deleted if more than 6 months have passed since its creation - regardless of whether the agreement for the provision of Services is still in effect. The Board's system record, lesson notes, and progress evaluation history are retained. The User should download a copy of any important Board content before this deadline if they wish to keep it.

11. Intellectual property

11.1. The Service (source code, graphic layout, logo, own task database, documentation) is the property of the Service Provider or its licensors and is protected by copyright and other intellectual property protection regulations.

11.2. Using the Service does not transfer to the User any rights to the software, trademarks, designs or other elements of the Service Provider’s intellectual property.

11.3. The exam tasks made available in the task database come from exam papers published by the Central Examination Board and are used for educational purposes, to the extent permitted by law and by the terms of use of CKE materials. The papers may contain works of third parties (e.g. excerpts of literary texts, illustrations, recordings) whose rights belong to their owners. The User does not acquire any rights to these materials and may not distribute them outside the Service. If you believe that any content in the Service infringes your rights, write to kontakt@lern.one and we will review it promptly.

11.4. User Content remains their property. The Service Provider obtains only a licence to process it in accordance with §10.

12. AI Assistant

12.1. The AI Assistant is an artificial intelligence system, not a human. It generates content (lesson plans, quizzes, flashcards, task suggestions) automatically, based on language models provided by Anthropic PBC.

12.2. Content generated by the AI Assistant may contain errors, inaccuracies or outdated information. The User undertakes to verify the generated content each time before using it in work with Students.

12.3. The Service Provider is not liable for the consequences of the User relying on incorrect AI Assistant answers without verifying them.

12.4. Limits. Use of the AI Assistant is subject to token limits depending on the Tariff plan. Once the limit is exhausted, the feature is unavailable until the end of the Billing period.

12.5. Prohibition on entering sensitive data. The User does not enter into the AI Assistant any special categories of personal data (Art. 9 GDPR) or data covered by professional secrecy.

13. Tutor as Service Recipient

13.1. A Tutor who concludes the agreement with the Service Provider in the course of a business activity of a professional nature is not a Consumer and has no right of withdrawal under §7.2. A sole trader who concludes an agreement directly related to their business but not of a professional nature for that business enjoys consumer protection to the extent provided by law.

13.2. Entrustment of processing. Upon entering Students’ personal data into the Service, the Tutor concludes with the Service Provider a personal data processing agreement in accordance with Art. 28 GDPR. The Tutor remains the controller of that data - details in the Privacy Policy § 15 and 16.

13.3. The Tutor is responsible to their Students for:

  • fulfilling the information obligations under Art. 13-14 GDPR,
  • obtaining the required consents (e.g. of legal guardians),
  • the quality of the tutoring services provided - the Service Provider is not a party to the agreement between the Tutor and the Student.

13.4. Public profile. The content of the Tutor’s public profile (description, subjects, reviews) must comply with the law and good practice and must not mislead Students. The Service Provider may hide a profile whose content violates the above rules.

14. Payments Student → Tutor

14.1. Billing model. Lern.one operates as a SaaS platform - it charges the Tutor a subscription fee and a commission of 1.5% on each Student → Tutor transaction handled via Stripe Connect.

14.2. Stripe Connect. A Tutor who wishes to accept online payments creates a Stripe Express account (Standard Connected Account) through the Service and undergoes KYC verification carried out by Stripe. The Stripe account is subject to separate terms defined by Stripe Payments Europe Ltd.

14.3. Direct charges. The Student’s payment goes directly to the Tutor’s Stripe account. Lern.one collects a 1.5% commission in the form of an application fee from each transaction.

14.4. Refunds and returns. Refunds are disabled in the Express Dashboard. The Tutor handles refunds outside Stripe (cash, transfer, voucher). A chargeback via the Student’s bank remains possible (regardless of the Tutor’s will).

14.5. Negative balance. Stripe may auto-debit the Tutor’s bank account in the event of a negative balance (chargebacks, refunds outside Stripe). Lern.one is not liable for settlements between the Tutor and the Student or for the consequences of such a debit.

14.6. Payouts. The Tutor decides on the payout schedule in the Express Dashboard (daily / weekly / manual). Lern.one does not set the payout schedule or mediate in the payout itself.

15. Liability of the Service Provider

15.1. The Service Provider exercises due diligence to keep the Service available, functional and secure. It does not guarantee uninterrupted availability or freedom from errors beyond what follows from the agreement and mandatory provisions of law.

15.2. Liability towards Consumers. Towards Consumers, the Service Provider is liable under the general rules of the Civil Code and the Consumer Rights Act. These Terms neither exclude nor limit the Consumer’s rights arising from mandatory legal provisions.

15.3. Liability towards Tutors. Towards Tutors (as entities conducting business activity), the Service Provider’s liability is limited to actual damage (excluding lost profits) and to the equivalent of the fees paid by the Tutor in the last 12 months. The limitation does not apply to damage caused intentionally.

15.4. Exclusion of liability. The Service Provider is not liable for:

  • the content and quality of lessons conducted between the Tutor and the Student,
  • the correctness of content generated by the AI Assistant without verification by the User,
  • data loss caused by the User’s actions (e.g. deletion on their own),
  • force majeure events (failure of telecommunications operators’ infrastructure, DDoS attacks),
  • damage resulting from the User’s breach of these Terms,
  • the actions of other Users (e.g. improper behaviour of a Tutor towards a Student),
  • the Tutor’s tax and accounting settlements.

15.5. Maintenance. The Service Provider reserves the right to periodic technical breaks for infrastructure maintenance. Planned breaks are announced in advance; emergency breaks may occur without prior notice.

16. Complaints

16.1. The User submits complaints regarding the Service by e-mail to kontakt@lern.one.

16.2. Content of the complaint. The complaint should contain the User’s name (or company), the Account e-mail address, a description of the subject of the complaint and the expected manner of its handling.

16.3. Deadline. The Service Provider handles the complaint within 14 days of its receipt. Towards Consumers, failure to respond within this period is equivalent to acceptance of the complaint to the extent provided by the Consumer Rights Act. For Users who are not Consumers, the deadline in complicated cases may be extended to 30 days, of which the User is informed.

16.4. Reply. The reply to the complaint is provided by e-mail to the address from which the complaint was sent, or another indicated by the User.

17. Disputes and applicable law

17.1. These Terms are governed by Polish law.

17.2. Competent court. Disputes arising from the Terms are heard by the competent common court:

  • for Consumers - according to the general provisions of the Code of Civil Procedure (usually the court of the Consumer’s place of residence),
  • for entrepreneurs - the court competent for the Service Provider’s registered office.

17.3. Out-of-court dispute resolution. The Consumer may use out-of-court methods of dispute resolution - detailed information is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organisations dealing with consumer protection and the Voivodeship Inspectorates of the Trade Inspection.

17.4. List of authorised entities. The list of entities authorised to conduct out-of-court consumer dispute resolution is maintained by the President of the Office of Competition and Consumer Protection (uokik.gov.pl).

18. Changes to the Terms

18.1. The Service Provider may amend the Terms for important reasons, which include: changes in law or in guidance of authorities, court rulings and decisions of authorities, changes to the scope or operation of the Service (new features, withdrawal of features, change of technical providers), security reasons and prevention of abuse, changes in the cost of providing the Services, and correction of obvious errors.

18.2. The User will be informed of changes to the Terms by e-mail or by a notice in the Service at least 14 days in advance.

18.3. A User who does not accept the changes may terminate the agreement before they take effect by deleting the Account. Continued use of the Service after that date means acceptance of the changes. If a Consumer terminates the agreement in this way because of a change that worsens the terms of the Subscription during a paid Billing Period, the Service Provider refunds the fee for the unused part of that Period.

18.4. Price changes. A change in the prices of existing Subscriptions does not affect the prices of already paid Billing periods - the new price applies only from the next period after the change takes effect.

19. Final provisions

19.1. In matters not regulated by these Terms, the provisions of Polish law apply, in particular: the Civil Code, the Act of 18 July 2002 on the provision of electronic services, the Consumer Rights Act of 30 May 2014 and the GDPR.

19.2. Severability clause. If any provision of the Terms is held to be invalid or ineffective, the remaining provisions remain in force. The invalid provision is replaced by the provision closest to the economic and legal purpose of the invalid provision.

19.3. The Terms are effective from October 17, 2026.

19.4. The current version of the Terms is available at https://lern.one/regulamin. The Terms can be saved or printed from the browser, and on request sent to kontakt@lern.one we will send them by e-mail.
